The plaintiff in this lawsuit, Soprema, alleges breach of contract claims, unjust enrichment and conversion claims arising out of a project in Hawaii. The First Amended Complaint, removed to this Court from the Medina County Court of Common Pleas, states that in December 2006 A-1 began installing a Soprema roofing product on four buildings in the Queens’ Market Place construction project and that due to performance issues A-1 contracted with Bodell Construction Company (“Bodell“) to supplement and complete their work. Both A-1 and Bodell were authorized Soprema roofing contractors per written agreements with Soprema and had to have their installation work inspected by Soprema before being issued a product warranty.
